Summary: As of September 1st, 2025, the Texas Secretary of State will require businesses that send SMS or MMS messages to a Texas resident (or businesses that are operating from Texas) to register with the Texas Secretary of State, unless an exemption applies.
Impacted customers: All businesses that send SMS or MMS messages to Texas residents (or to those operating from Texas).
What is changing and why
All solicitors that send SMS or MMS messages to a Texas resident (or businesses that are operating from Texas), must now formally register with the Texas Secretary of State or be subject to fines and civil litigation. Our goal is to make sure Talkdesk customers are aware so they can take any steps needed.
Registration requirements include:
- Submit a Telephone Solicitation Registration Statement and other documentation to the Texas Secretary of State.
- Submit the application fee and a form of security deposit.
- Review the FAQs published by the Texas Secretary of State to assist with the new registration requirements.
Important Note: The registration must be renewed annually.
Key exemptions:
- When sending to current or former customers.
- When sending on behalf of an educational institution or a 501(c)(3) nonprofit organization.
- If the business is a publicly traded corporation.
- If the business is a supervised financial institution.

The change will go into effect on Monday, September 1, 2025.
Action required from customers
